Terms & Conditions
Effective from: 1 March 2025
The following terms govern the relationship between Melakaben Horology ("the Studio") and clients who use its services or visit its website. The Studio asks that you read them carefully before proceeding with any service. By engaging the Studio or using this website, you acknowledge and accept these terms.
1. Definitions
- "The Studio" refers to Melakaben Horology, operating from 53 Persiaran Tropicana, 47410 Petaling Jaya, Selangor, Malaysia.
- "Client" refers to any individual or entity that submits a watch to the Studio for assessment or service, or who engages the Studio for a consultation.
- "Piece" refers to any wristwatch, pocket watch, or related item submitted to the Studio.
- "Service" refers to any bench work, consultation, assessment, or informational session offered by the Studio.
- "Service Record" refers to the Studio's written or photographic documentation of work carried out on a submitted piece.
2. Engaging a Service
All services begin with an initial enquiry, which may be made by telephone, email, or in person. The Studio will assess whether the requested service is appropriate for the piece and confirm scope, timeline, and pricing before work commences.
Work begins only after the Client has confirmed their agreement to the quoted scope and price. Verbal or written confirmation is accepted. The Studio reserves the right to decline a service request where the piece's condition makes the outcome uncertain or where required components are unavailable.
Where additional issues are discovered during the course of work that were not visible at initial assessment, the Studio will contact the Client to discuss before proceeding. No additional work is carried out without Client agreement.
3. Pricing and Payment
All prices are quoted in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise stated. Published prices on the Studio's website reflect standard scope; complex cases may carry a different fee, which will be communicated before work begins.
Payment is due upon collection of the piece or upon delivery of a completed informational session. The Studio accepts payment by cash and bank transfer. Receipts are issued for all transactions.
Where a piece is not collected within sixty days of completion and the Studio has made reasonable attempts to contact the Client, the Studio reserves the right to apply a storage holding charge of RM 10 per week thereafter.
4. Submission of Pieces
The Client warrants that they are the rightful owner of any piece submitted, or that they have authority from the owner to submit it for service. This includes inherited pieces and pieces submitted on behalf of another person.
The Studio will photograph and document the condition of each piece upon receipt. This record is maintained in the Studio's files and shared with the Client upon request.
The Studio takes reasonable care of all pieces while they are in its possession. Pieces are stored securely on the studio premises and are not removed from the premises except where a service specifically requires it, in which case the Client will be informed.
5. Scope of Responsibility
The Studio carries out work with care and relevant technical knowledge. However, watchmaking involves inherent variables — including the age and condition of components, the availability of period-correct parts, and the behaviour of aged materials — that are not fully within the Studio's control.
The Studio's liability for any loss or damage arising from services is limited to the fee paid for the service in question. The Studio does not accept liability for pre-existing damage, age-related deterioration, or issues that were not apparent at initial assessment and could not reasonably have been foreseen.
For pieces of declared sentimental or monetary value, the Client is encouraged to discuss this with the Studio prior to submission. The Studio does not provide insurance valuations; Clients with high-value pieces are advised to arrange their own cover.
6. Timing and Completion
Estimated completion times are provided in good faith. The Studio works at a measured pace appropriate to bench work of this nature. Timelines may extend where sourcing of period-correct parts requires additional research, or where the piece reveals unexpected complexity once disassembled.
The Studio will communicate proactively where a delay is anticipated. Rush timelines are not accommodated, as the quality of bench work depends on unhurried attention.
7. Informational Consultations
Where the Studio provides an informational consultation — such as the Watch Travel Care Notes service — the content discussed is general in nature. It is based on the Studio's knowledge and experience and is intended to assist the Client in making their own decisions.
Informational content is not a substitute for professional advice in specialist areas. The Studio does not accept responsibility for decisions made by the Client on the basis of consultation content.
8. Website and Intellectual Property
All content on this website — including text, descriptions, and design — is the property of Melakaben Horology. It may not be reproduced, adapted, or distributed without the Studio's written permission.
The Studio's website is provided for informational purposes. The Studio endeavours to keep information current but does not warrant that all content is accurate or complete at any given time.
9. Privacy
The Studio's handling of personal data is described in the Privacy Policy, which forms part of these terms. By engaging the Studio's services, you acknowledge the privacy practices described there.
10. Governing Law
These terms are governed by the laws of Malaysia. Any dispute arising from a service or from the use of this website will be subject to the jurisdiction of the Malaysian courts.
The Studio's preference is always to resolve any concern informally and in good faith. Clients are encouraged to contact the Studio directly in the first instance.
11. Changes to These Terms
These terms may be revised from time to time. The effective date at the top of this page reflects the most recent revision. Continued use of the website or Studio services after a revision constitutes acceptance of the updated terms.
